Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website sugaullet.com and the renovation services provided by Inhaus Living Pty. Ltd. ("Company", "we", "us", "our"). Our registered address is Supa Center Moore Park, 2a Todman Avenue, Kensington, NSW 2033.

1. Acceptance of Terms

By accessing our website, requesting a quotation, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services. These Terms apply in addition to any written contract we enter into with you for a specific project.

2. Services Description

Inhaus Living Pty. Ltd. provides renovation and building services in Canberra and Sydney, Australia, including but not limited to:

  • Apartment renovations
  • Kitchen remodeling
  • Bathroom upgrades
  • Home additions

We hold appropriate licences and insurance as required under NSW and ACT building legislation. Specific scope of work for each project will be detailed in a written quotation and/or contract.

3. Quotations and Pricing

  • Quotations are valid for 30 days from the date of issue unless otherwise stated.
  • Quotations are estimates based on information provided by you. Final pricing may vary if site conditions, scope, or specifications change.
  • We reserve the right to revise quotations if there are delays caused by the client, variations requested, or unforeseen site conditions.
  • All prices are in Australian dollars (AUD) and include GST unless otherwise specified.

4. Payment Terms

  • Deposit: A deposit (typically 10–20% of the contract value) may be required to secure your project and order materials.
  • Progress payments: Payments are due at agreed milestones (e.g., upon completion of stages such as demolition, rough-in, fit-out).
  • Final payment: The balance is due upon practical completion and handover, subject to any agreed retention.
  • Payment methods: Bank transfer, cheque, or other methods as agreed. Payment terms are typically 7–14 days from invoice date.
  • Late payment: We may charge interest on overdue amounts at a rate of 2% per month or the maximum rate permitted by law, whichever is lower.

5. Project Timelines

  • We will provide an estimated timeline in the quotation. Timelines are estimates and may be affected by weather, material availability, council approvals, variations, or other factors beyond our control.
  • We will endeavour to keep you informed of any delays and their causes.
  • Delays caused by the client (e.g., late decisions, access issues, delayed payments) may result in revised completion dates and potential additional costs.

6. Variations

Any changes to the agreed scope of work must be documented in writing. Variations may affect the contract price and timeline. We will provide a written variation quote before proceeding with additional work.

7. Warranties

  • We warrant that our work will be carried out in a proper and workmanlike manner and in accordance with applicable building codes and standards.
  • We provide a statutory warranty under the Home Building Act 1989 (NSW) and equivalent legislation in the ACT where applicable. Major defects are warranted for 6 years; other defects for 2 years.
  • Manufacturer warranties apply to materials and fixtures supplied by us. We will pass on relevant warranty documentation where available.
  • Our warranty does not cover damage caused by misuse, neglect, unauthorised modifications, or events outside our control.

8. Limitation of Liability

  • To the fullest extent permitted by law, our liability for any claim arising from or in connection with our services is limited to the amount paid by you for the relevant project or the cost of rectification, whichever is less.
  • We are not liable for indirect, consequential, or incidental damages, including loss of profit, loss of use, or delay.
  • Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law or other applicable law that cannot be excluded by agreement.

9. Intellectual Property

All designs, drawings, plans, and documentation prepared by us remain our intellectual property unless otherwise agreed in writing. You receive a licence to use such materials for the purpose of your project. We may use project photographs for our portfolio and marketing unless you expressly object in writing.

10. Client Obligations

You agree to:

  • Provide accurate information about the property and project requirements
  • Ensure we have safe and uninterrupted access to the site during agreed hours
  • Obtain any necessary approvals (e.g., strata, council) before work commences
  • Make payments in accordance with the agreed schedule
  • Notify us promptly of any concerns or defects

11. Termination

  • Either party may terminate a contract in accordance with the terms of the written contract.
  • We may suspend or terminate work if payments are overdue, access is denied, or you breach material terms.
  • Upon termination, you must pay for all work completed and materials ordered or delivered. See our Return and Refund Policy for further details.

12. Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Changes

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
